2. The Services
Lekana provides software tools for South African legal research and practice, including research, drafting assistance, document preparation and review, deadline calculations, matter management, and third-party integrations. Available features depend on your plan and may change over time.
We may improve, replace, or discontinue features. We will give reasonable notice of a material change that significantly reduces a paid Service where required by law or a separate written agreement.
3. Accounts and organisations
You must have legal capacity to enter into these Terms, provide accurate information, protect your login credentials, and promptly tell us about suspected unauthorised access. You are responsible for activity through your account unless it results from a failure for which Lekana is legally responsible.
4. Professional use and verification
Lekana provides software, not legal services. Lekana is not a law firm, does not act as your attorney, and does not create an attorney-client relationship.
The Services may provide research results, summaries, citations, calculations, deadline information, drafts and other outputs, including outputs produced using artificial intelligence. These outputs are intended to assist your work and do not replace professional judgment.
You must review and verify relevant outputs against the applicable law, primary sources, court rules, practice directives and facts of the matter before relying on them, providing advice, filing documents or taking other professional action.
You remain responsible for the professional services you provide, the decisions you make and the documents or other work product you produce using the Services.
5. Your content
“User Content” means information, questions, files, case records, documents, and other material you submit to Lekana. You retain your rights in User Content.
You give Lekana a limited, non-exclusive licence to host, copy, transmit, and process User Content only as reasonably necessary to provide, secure, support, and administer the Services, or to comply with law.
You must have the authority and lawful basis to submit User Content. You remain responsible for client confidentiality, legal privilege, personal-information obligations, and deciding what information is appropriate to place in the Services.
6. Acceptable use
You may not:
- use Lekana unlawfully or infringe another person’s rights;
- submit content you are not authorised to use or disclose;
- compromise another account or circumvent access, seat, or security controls;
- introduce malware, interfere with the Services, or attempt unauthorised access;
- scrape, overload, or systematically extract the Services except through an authorised interface;
- misrepresent machine-generated material as having been verified when it has not; or
- copy, reverse engineer, resell, or exploit the Services except as permitted by law or in writing.
7. Lekana and output rights
Lekana and its licensors retain all rights in the platform, software, branding, designs, and proprietary materials. We give you a limited, revocable, non-transferable right to use the Services while your account is authorised and subject to these Terms.
Subject to applicable law and third-party rights, you may use outputs generated for you. AI-generated outputs may not be unique, and other users may receive similar material. Public legal authorities and third-party materials remain subject to their existing rights and permitted uses.
8. Third-party services and sources
Lekana may connect to or rely on services and sources such as Paystack, Court Online, Microsoft Outlook, cloud and AI providers, and public legal databases. Their services may be governed by their own terms and availability. We are not responsible for a third party changing, suspending, or withdrawing its service, but this does not limit any responsibility Lekana cannot lawfully exclude.
9. Fees and recurring billing
The price, currency, billing interval, taxes, and plan features applicable to a purchase will be shown before checkout. Paystack processes subscription payments. By purchasing a recurring subscription, you authorise Paystack to charge the selected payment method at the displayed interval until cancellation.
We may change future subscription prices on reasonable prior notice. A price change does not apply retrospectively. Failed or overdue payments may result in restricted or suspended paid access after any notice required by law.
10. Cancellation and refunds
Paid subscriptions renew until cancelled. Our Cancellation Policy explains how to stop renewal, and our Refund Policy explains when refunds are available. Both policies form part of these Terms.
11. Service availability
We use reasonable efforts to keep the Services available, secure and operating as intended. Access may occasionally be interrupted or restricted while we perform maintenance, implement updates, address security concerns or respond to circumstances beyond our reasonable control.
We may modify, suspend or discontinue free, trial, beta or preview features. Where reasonably practicable, we will give you notice of any material change that significantly affects a paid Service.
12. Suspension and termination
We may suspend or terminate access for material breach, unlawful use, a material security risk, or non-payment. We will provide notice and an opportunity to remedy a breach where required by law and reasonably possible.
You may stop using Lekana at any time and may cancel a paid subscription under the Cancellation Policy. Following termination, access to some User Content or paid features may end, subject to applicable law and any separately agreed export or retention terms.
13. Changes to these Terms
We may update these Terms and will post the revised version with a new date. For a material change, we will provide reasonable notice by email, in the application, or both.
14. Governing law and disputes
South African law governs these Terms. The courts of South Africa having jurisdiction may hear disputes, without limiting any right to approach a consumer commission, tribunal, ombud, or other forum available under applicable law.
15. General
If a provision of these Terms is invalid or unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our written consent; we may transfer them as part of a merger, reorganisation, or sale of the relevant business, subject to applicable law.
These Terms, the policies linked from them, and any applicable order form are the entire agreement about the Services. Headings are for convenience only.
